In recent years, off campus training classes have expanded rapidly, with students ranging from middle school students, primary school students to preschool children. Among them, disciplinary training classes are particularly popular, CCTV reported. Parents rush to school training, invest a lot of money and energy, in order to get a beautiful resume, to win a high-quality school "stepping stone". Consultation on disciplinary measures in the "rules of punishment for primary and secondary education (Trial)"

Question: Question 1: the interpretation of "expulsion from school" in the "rules" is not clear. Does the punishment of "expulsion from school" approved by the procedure mean the cancellation of the school's student status? Does he still reserve the right to transfer? Or after the online cancellation of student status, the student can not study in the same ordinary high school and vocational school?

Question 2: in the management practice of ordinary high schools, some students seriously violate discipline, such as beating, scolding and hurting teachers. According to the previous treatment, most of them are "ordered to drop out", that is, they are not allowed to study in their own school, and are generally allowed to transfer. Is there any punishment of "order to drop out" in the school rules made by the school itself, or is it in violation of the rules? (message time: March 9, 2021)

Reply: About Question 1. "Expulsion from school" in the "rules" refers to the disciplinary measures that can be taken against students in senior high school. Their school status is still kept in the school status information management system, but there is no legal educational management relationship between students and schools. Transfer is not a right, there is no transfer after expulsion. After being expelled from school, whether students can continue to receive education in other schools depends on the requirements and wishes of relevant schools. In addition, high school students who have been expelled can still take part in the college entrance examination as social examinees if they have achieved the same academic level after graduating from high school through self-study. After being admitted by colleges and universities, they can also obtain the status of students in Colleges and universities.

On question two. At present, the punishment types stipulated in the "rules" include warning, serious warning, demerit recording, detention for inspection, expulsion from school and so on. The school regulations stipulate that "ordering students to leave school" can be regarded as a kind of compulsory measure, that is, requiring students to leave school within a limited time. If it does not explicitly violate the provisions of the upper law, it can be retained. However, due to the serious consequences of its behavior, it is equivalent to expulsion from school, so the procedure of expulsion from school should be referred to. (Ministry of education website)
